FoxPeek Terms of Use

1. Description of Services

FoxPeek is a device information and specification analysis utility for iOS users. Based on sysdiagnose files, Analytics files, or other supported files that you choose to import, the App can parse, organize, and display information about device specifications, displays, batteries, cameras, storage, memory, and other components. Depending on the features available, it may also provide report saving, history, sharing, and other supporting services.

The App’s analysis results are primarily generated from information available in system files, publicly available device information, and the App’s parsing rules. Results may be unavailable, incomplete, or displayed differently due to factors such as the system version, device model, file source, file completeness, or system permission restrictions.

2. Scope and Application of These Terms

These Terms apply to the FoxPeek app, in-app pages, related websites, technical support pages, and services associated with the App’s features. Unless separate terms are issued, these Terms will also apply to any future features, services, versions, or platforms of the App.

These Terms also incorporate our current and future Privacy Policy, instructions, feature notices, page rules, operating guidelines, and other relevant rules. Those rules have the same effect as these Terms.

3. Conditions of Use

1. You must have the legal capacity to enter into these Terms. If you are a minor, you must use the App with the consent and guidance of your parent or legal guardian.
2. You must comply with the laws and regulations of the People’s Republic of China, the applicable laws and regulations of your location, and the relevant Apple App Store rules when using the App.
3. You must ensure that files you import, parse, or save are obtained lawfully and that you have the right to process their contents.
4. You must not use the App for any unlawful activity, infringement of another party’s rights, or disruption of the App’s normal operation.

4. File Import and Analysis Results

The core features of FoxPeek generally require you to select and import relevant files. You understand and agree that:

1. The App does not independently access your sysdiagnose files, Analytics files, or other local files. It reads and parses a file only after you choose, share, or import it.
2. The App seeks to perform file parsing and report generation locally. Unless you choose to share or submit feedback, or provide separate authorization, the App does not independently upload your imported original files, parsed reports, device serial numbers, battery reports, or similar content to a server.
3. Analysis results are provided only to help you understand device information and specifications or support your own assessment. They do not constitute an official inspection, repair assessment, quality certification, transaction guarantee, or professional conclusion of any kind.
4. Some information may be unavailable or not completely accurate due to changes in system file structures, missing fields, damaged files, modifications by third-party tools, device system limitations, or similar causes.
5. You are responsible for determining whether an analysis result is suitable for your purposes. For important matters involving used-device transactions, repairs, post-sale support, warranties, or legal disputes, you should also consider inspection results from Apple’s official channels, authorized service providers, or other professional organizations.

5. User Conduct

When using FoxPeek, you must not:

1. Analyze files that are unlawful, stolen, forged, altered, or obtained without authorization;
2. Upload, distribute, store, or process files containing unlawful or infringing content, malicious code, viruses, or other destructive material;
3. Disrupt the App’s features, membership mechanisms, data security, or normal operation through reverse engineering, decompilation, cracking, hooking, injection, bypassing restrictions, or similar means;
4. Use the App to generate false or misleading reports or use reports for fraud, false advertising, malicious transactions, or similar purposes;
5. Impersonate the App, its developer, a partner, or Apple when making promotional, sales, inspection, or after-sales representations;
6. Copy, modify, distribute, sell, rent, or transfer the App or its content, interface, icons, text, report templates, or related resources without authorization; or
7. Engage in any other conduct that violates laws and regulations, public order and good morals, platform rules, or the lawful rights and interests of the App or other users.

6. Accounts, Data, and Local Reports

Depending on the features available, the current version of FoxPeek may save analysis records or report data locally on your device. You understand and agree that:

1. Local reports, history records, and related data may be stored on your device. This data may be deleted or become unrecoverable if you uninstall the App, clear its data, change devices, or experience a system failure.
2. You are responsible for properly safeguarding important reports or screenshots. If you use analysis results externally, you must verify their accuracy yourself.
3. If the App offers accounts, cloud synchronization, memberships, subscriptions, advertising, or other online services in the future, we will update the applicable rules or Privacy Policy, or provide an explanation within the App, based on the features actually offered.

7. Permissions and Privacy Protection

Depending on the features you use, the App may request system permissions for file access, saving to Photos, network access, notifications, and similar capabilities. For details about how permissions are used, how data is processed, and which third-party SDKs are integrated, please refer to the FoxPeek Privacy Policy.

8. Intellectual Property

Except for content owned by its respective rights holders, the intellectual property rights in the software, technology, programs, code, interface designs, icons, graphics, text, report styles, layouts, trademarks, service marks, and feature processes of FoxPeek and its related services belong to the Company or its lawful licensors.

Without our prior written consent, you must not copy, modify, distribute, display, sell, rent, reverse engineer, disassemble, mirror, scrape, or use such content to develop similar or competing products or for any other commercial purpose.

9. Disclaimers

1. Device information, specification analysis, ratings, identification results, reports, and other content provided by the App are for reference only. They do not represent an official conclusion from Apple and do not constitute inspection certification, a repair assessment, a transaction guarantee, or professional advice.
2. We will make reasonable efforts to improve recognition failures, result differences, or data loss caused by system version changes, device differences, damaged files, missing fields, user error, modifications by third-party tools, or other factors beyond our control, but we are not liable for resulting losses beyond the scope required by law.
3. You are responsible for assessing and accepting the risks and consequences of any purchase, sale, repair, rights claim, transaction, or other decision made using or relying on the App’s analysis results.
4. We are not liable beyond the scope required by law for service interruptions, limited functionality, or data anomalies caused by force majeure, network failures, system maintenance, third-party service failures, changes to App Store policies, operating system restrictions, or similar causes.

10. Service Changes, Interruptions, and Termination

We may adjust the App’s features, service content, page presentation, pricing methods, or related rules in response to business development, technology upgrades, system maintenance, laws and regulations, or platform requirements. We will provide notice of material changes within a reasonable scope through an in-app notice, page announcement, update to these Terms, or another appropriate method.

If you violate these Terms, applicable laws and regulations, or platform rules, we may lawfully restrict features, discontinue services, remove unlawful content, pursue liability, or take other appropriate measures.

11. Updates to These Terms

We may revise these Terms in response to laws and regulations, regulatory requirements, platform rules, or product feature changes. The updated Terms will be published on this page or within the App and will take effect on the stated effective date or the date of publication.

If you continue to use the App after these Terms are updated, you acknowledge that you have read, understood, and accepted the updated Terms. If you do not agree with the updated Terms, please stop using the App and its related services.

12. Governing Law and Dispute Resolution

The formation, performance, interpretation, and dispute resolution of these Terms are governed by the laws and regulations of Mainland China. Any dispute arising from these Terms or the App’s services should first be resolved through good-faith consultation. If consultation fails, either party may bring an action before a court of competent jurisdiction in accordance with law.
